For the purposes of UK data protection law, Luke (trading as Footfall Digital) is the data controller for the personal data described in this notice.
This notice applies to visitors to the Footfall Digital website, and to anyone who submits the contact form or the free audit (search-gap check) form on this site.
It does not cover the separate service agreement signed by paying clients, and it does not cover any data processing carried out later on behalf of a paying client for that client's own customers. That work, if and when it happens, is governed by the client's own contract and privacy arrangements, not this notice.
We only collect what you choose to give us, plus the small amount of technical data that comes automatically with any website visit.
Information you submit to us:
Name
Email address
Phone number (if provided)
Business name and trade
Town or location
Any message, enquiry details, or information you give us as part of a free audit request
Technical data collected automatically:
IP address
Browser type
Date and time of visit
Pages requested
This technical data is standard information logged by most web hosting as part of running and securing a website. We do not currently use analytics tools, advertising tools, or tracking cookies, so we do not collect browsing behaviour, interests, or advertising identifiers. See section 10 for more on cookies.
We do not collect any data beyond what is listed above. If that changes, this notice will be updated first.
Under UK GDPR, we must have a lawful basis for everything we do with personal data. Here is what we do, and why:
| What we do | Why | Legal basis |
|---|---|---|
| Reply to your enquiry via the contact form | So we can answer your question or discuss your project | Steps taken at your request prior to a contract, and our legitimate interest in responding to enquiries |
| Carry out the free audit (search-gap check) you requested | To deliver the audit you asked for | Steps taken at your request prior to a contract |
| Keep a record of your enquiry and our reply | So we have a record of what was discussed and agreed | Legitimate interest in maintaining accurate business records |
| Protect the website and deal with misuse, disputes, or legal claims | To keep the site secure and meet legal obligations | Legitimate interest, and legal obligation where applicable |
We do not add anyone to a mailing list from a contact or audit form submission. We do not sell personal data to anyone, under any circumstances.
We do not sell your data. We share it only with:
Cloudflare (website hosting) — stores the website and any data submitted through it, acting on our instructions
Google Workspace (email) — used to receive and reply to enquiries sent via the contact or audit form
Google Fonts (website fonts) — the fonts on this website are loaded from Google's servers, which receive your IP address when a page loads
Professional advisers, insurers, or authorities (such as the ICO or HMRC), but only where we are required to share information with them
Cloudflare and Google may process data outside the UK, including in the United States. Where they do, the transfer is covered by an appropriate legal safeguard under their data processing terms, such as the UK Extension to the EU-US Data Privacy Framework, the UK International Data Transfer Agreement (IDTA), or the UK Addendum to the EU Standard Contractual Clauses.
Enquiry and audit records: kept for up to 24 months after our last meaningful contact with you, unless a client relationship begins (in which case different retention terms apply under the service agreement) or we need to keep the record for a legal claim, tax, or dispute reason.
Server logs: kept for the shorter period set by our hosting provider. We aim for no longer than 12 months unless there's a specific security reason to keep them longer.
We take reasonable technical and organisational steps to protect the personal data we hold, including limiting access to Luke as the sole person operating Footfall Digital. No method of storing or transmitting data online can be guaranteed 100% secure, but we take this responsibility seriously and review our practices as the business grows.
Under UK GDPR, you have the right to:
Access the personal data we hold about you
Rectification of inaccurate or incomplete data
Erasure of your data in certain circumstances ("right to be forgotten")
Restriction of how we use your data in certain circumstances
Object to our use of your data where we rely on legitimate interests
Portability of your data, where this applies
To exercise any of these rights, email [email protected]. We will respond within one calendar month.
We do not carry out any automated decision-making or profiling using your data.
If you are unhappy with how we have handled your data, you have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk.
This website and its forms are intended for business owners and decision-makers, not children. We do not knowingly collect personal data from children.
This website is not currently intended to use non-essential cookies, analytics tools, advertising cookies, or advertising pixels. If we introduce analytics, advertising, embedded media (such as video), or any other non-essential cookies in the future, we will update this notice first and put appropriate consent mechanisms in place before those tools go live.
We may update this privacy notice from time to time, for example if the services on this website change or the law requires it. The "last updated" date at the top of this notice will always reflect the most recent version. We encourage you to check back periodically.

By using this website you agree to these terms. If you do not agree, please do not use the site.
This site provides information about Footfall Digital and a way to get in touch or request a free search-gap audit. It is an informational and enquiry site, not a client portal or online store.
These terms govern use of the website, the contact form, and the free audit / search-gap form only. They are not the client service agreement. Paying work of any kind, including a website build, Google Business Profile setup, listings, hosting, monthly care, the founding offer, any setup fee, or cancellation terms, starts only when a separate written agreement is signed by both parties.
Any pricing, offers, or packages shown on this site are an invitation to treat, not a binding offer, and may change at any time before a separate written agreement is signed.
The free audit (or search-gap check) offered on this site is a manual or desk-based review of publicly available information about a business's online presence. It is:
Not a guaranteed or exhaustive analysis
Not legal, financial, or marketing advice
Not a promise of calls, jobs, search rankings, or revenue of any kind
We may decline, limit, or delay an audit at our discretion. Submitting the audit form or contact form is a request for information only. It does not place an order and does not create a contract between you and Footfall Digital.
This site does not take online payments and does not operate user accounts. Please do not send card details, bank details, or other payment information through the contact form or audit form. Any invoicing or payment for paid services is arranged separately, under the client service agreement.
When using this site or submitting a form, you agree not to:
Submit anything unlawful, harmful, infringing, misleading, or abusive
Attempt to scrape, copy, or systematically extract content from the site
Disrupt the site, introduce malware, or attempt to access non-public areas
Impersonate another person or business, or submit false information
We may refuse or remove any submission and may suspend or restrict access to the site for anyone who breaches these terms.
By submitting the contact form or audit form, you confirm that:
You have the right to send the information you provide
You grant Footfall Digital a limited right to use that information to reply to your enquiry and carry out the requested audit
Please do not send confidential information or special category data (such as health information) through these forms. See our Privacy Policy for how submitted information is handled.
The text, design, layout, templates, and branding on this site belong to Footfall Digital or its licensors, unless stated otherwise. You are given a personal, non-commercial, revocable licence to view the site for your own use.
You may not copy, reproduce, or reuse the site's template, copy, design, or audit method for resale or to build a competing product or service. This does not affect ownership of deliverables produced for paying clients, which is dealt with separately in the client service agreement.
This site may reference or link to third-party platforms such as Google, Google Maps, Facebook, or similar services. Footfall Digital does not control these platforms, and their own terms and privacy policies apply when you use them.
This website and the free audit are provided "as is." We take reasonable care in operating the site, but we do not guarantee that it will be error-free, secure, or available at all times.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.
If you are a business user: we exclude all liability for indirect or consequential loss arising from your use of this website. Our total liability relating to your use of the website is capped at £100, or the amount you have paid for use of the website, whichever is greater (noting that use of the website itself is free).
If you are a consumer: nothing in these terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer law. Liability is limited only to the extent the law allows.
Any paid services you later agree to are governed entirely by the separate client service agreement, including its own liability terms, which may differ from this section.
Personal data submitted through this website is handled in accordance with our Privacy Policy, available at footfalldigital.uk/privacy.
We may update these terms from time to time. The version published on the site at the time of your visit applies. If any part of these terms is found unenforceable, the rest will continue to apply. These terms, together with the Privacy Policy, form the entire agreement relating to use of the website only, and do not affect any separate written agreement for paid services. A failure to enforce any part of these terms is not a waiver of our right to do so later.
If you have any questions about these terms, contact [email protected].
These terms are governed by the laws of England and Wales. Any dispute relating to use of this website is subject to the exclusive jurisdiction of the courts of England and Wales, except that nothing in this clause removes any mandatory right a consumer has to bring proceedings in the courts of their own country of residence.
